Environmental regulations continue to change and affect the risk faced by lenders, owners, and managers of real estate. while environmental rules in some areas have relaxed the due diligence provided by a phase 1 environment assessment, it still remains the best method to assess credit risk from environmental issues. Today many lenders have segmented their requirements for environmental due diligence based on the size of the loan being requested, the nature of the real estate being encumbered and operations of the borrower or tenant.
